Beyond Borders: The AfCFTA Digital Trade Protocol’s Infrastructure Problem

African Continental Free Trade Area, AfCFTA, Digital Trade Protocol, Wamkele Mene, Infrastructure

Perhaps the most ambitious of all the African Continental Free Trade Area’s (AfCFTA) protocols is the one on digital trade. Bringing Africa together under a single trade framework is already a monumental undertaking, but attempting to integrate the continent’s fragmented digital ecosystems into that greater ambition takes the challenge to an entirely new level.

“The general objective of this Protocol is to support the attainment of the objectives of the AfCFTA, stipulated in Article 3 of the AfCFTA Agreement, by establishing harmonised rules and common principles and standards that enable and support digital trade for sustainable and inclusive socio-economic development and the digital transformation of the continent” - AfCFTA Protocol on Digital Trade

It is crucial, before going any further, to remind ourselves of what the AfCFTA Protocols actually are. At their core, they are legal frameworks, rulebooks that define how the continent’s economies are meant to engage with one another. They are not magic bullets. They cannot, on their own, dissolve decades of structural inequality, uneven development, or entrenched fragmentation across Africa’s trade and digital landscapes.

Yet, misplaced hope has often led to a common misconception: that these protocols, once signed, have the power to compel governments, regional blocs, or citizens themselves into compliance. This was never their purpose. They set the stage for a “borderless Africa,” but it is ultimately up to each government, business, and institution to exercise the political will and collective responsibility necessary to turn those aspirations into reality.
